User agreement governs the provision procedure of services by the Company and the use of the Software product and the relationships arising during the use of the Software and the Services of Users.
The company doesn’t guarantee availability of Service 27/7. The company has the right at any time to deny any User to use the Software product in case of violation of the User Agreement, and for other reasons specified in the internal rules of the Company.
Company grants to users a personal, non-exclusive and non-transferable right to use the Software product, in accordance with this Agreement, provided that the User or any other person, with the assistance of the User will not perform actions:
A person over 18 years who wish to use the "ArtFive" service, must pass the registration procedure on the appropriate page of the Resource. When registering, the User must agree to this User Agreement and the Privacy Policy by clicking on the corresponding button on the welcome screen and registration will occur implicitly (upon entering the main screen of the Program).
Users are responsible for their actions/omissions when using the Software product. The user guarantees that the use of the Software will be implemented in a manner that will not violate the rights of the third parties. The user agrees to comply with this User agreement.
Upon the User's breach of this Agreement, Administration reserves the right to restrict the User's access to the Service temporarily, and in the case of gross and/or repeated violations of the User agreement, to refuse access to the Service.
Part of the Service’s revenue comes from subscriptions and in-app purchases in the Program. The user, at his discretion, can make an in-app purchase. Depending on the type of purchase, the user can unlock additional or exclusive content, unlock new features, get more content, etc. Each in-app purchase describes its specific benefits and costs. The main purchase in the application is the purchase of access (subscription) to all lessons for training in an online photo school.
The following rules are act for purchasing subscriptions: payments are debited from your Apple ID account at confirmation of purchase. Subscriptions are automatically renewed if they were not canceled at least 24 hours before the end of the current period. The fee is charged for updating within 24 hours before the end of the current period. Users can manage and cancel subscriptions in the account settings in the App Store.
Any purchases only grant access to the content for a specific subscription period or permanently, but do not give the right to commercial use or any distribution of the materials, including making copies, modifying images, videos, copying text, etc. The Content is for personal use only.
The Part of Service income comes from an advertisement, and the Service may display advertisements and promotions. By using the Service, User agrees that the Administration may place such advertisements and promotions on the Service. The manner, mode and extent of such advertising and promotions may be changed without notice.
The company provide no undertaking that the Software is error free or will operate uninterrupted.
The company is not responsible for losses or other damage occurred by the User in connection with actions of third parties.
Company reserves the right to remove from its servers any information or materials which in the opinion of the Company, are unacceptable, undesirable or in violation of this User agreement.
The company doesn’t control information, services and products offered or via the Internet. Consequently, the User accepts the condition, under which all merchandise, information and services offered or available through the Service or on the Internet (except those designated as provided directly by the Company expressly), provided by the third parties that are not connected with the Company.
The company will not be liable for any costs or damages directly or indirectly resulting from the User's use of the Service.
The Russian version of this Agreement is the main one and, in case of discrepancies with other languages, is the primary one.
The user agreement and all modifications shall enter into force upon their publication in the Application. Changes to the User agreement may be amended at any time.
The user undertakes to get acquainted with the current version of the User agreement before each use of the App, Services and/or Services of the Company. If the User decides not to agree to the amended User Agreement, he is obliged to refuse the Application.
The user continues the use of the App, Services and/or services of the Company agrees with the changes.
All relations between the Company and Users are subject to regulation exclusively by the legislation of Ukraine. In case of violation of the legislation of Ukraine, the User bears full administrative, criminal and civil liability.
